Body Corporate Legislation Changes<< Back to Blog
There are a number of Bills currently before Parliament that will impact on bodies corporate. Firstly, the Queensland Reconstruction Authority Bill 2011 was tabled in Parliament on the 14 February 2011. In accordance with the Ministerial statement issued by the Premier on Monday and, considering the urgency in the wake of the recent flood and cyclone disasters experienced by Queensland, the Bill was passed in its introduced form late last night.
This Bill changes the new pool rules specifically by providing a 6 month exemption to the leasing of non-shared pool premises and extending the applicability of pool safety management plans to class III buildings. Secondly, and more significantly, the second reading debate of the Body Corporate and Community Management and Other Legislation Amendment Bill 2010 , which concerns the regulatory framework for lot entitlements, is due to be resumed in Parliament.
Although the debate is not likely be resumed until sometime in March when Parliament next sits, it remains to be seen whether any further amendments will occur. Some additional submissions were recently made by the Property Council of Australia in relation to the Bill. Thirdly, the second reading debate of the Neighbourhood Disputes Resolution Bill 2010, which among other things relates to dividing fences, is also due to be resumed in Parliament.
